If you transact on MaMTus you shall be subject to the policies that are applicable to the website for such transaction. By mere use of the website you shall be contracting with GlobalPro Services Limited incorporated under Companies and Allied Matters Act, 1990 with registered office at House 8 G Close 5th Avenue Festac Town, Lagos, Nigeria. These terms and conditions constitute your binding obligations.

Membership Eligibility

Use of the MAMTUS Website is available only to persons who can form legally binding contracts under Nigerian governing laws. If you are a minor i.e. under the age of 18 years, you shall not register as a member or trade.

Your Account and Registration Obligations

If you use MaMTus Centre, you shall be responsible for maintaining the confidentiality of your User ID and Password and you shall be responsible for all activities that occur under your User ID and Password. You agree that if you provide any information that is untrue, inaccurate, not current or incomplete that MaMTus Centre has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, MaMTus Centre has the right to indefinitely suspend or terminate or block access of your membership with MaMTus Centre and refuse to provide you with access to the Website.

Communications

When You use the Website or other data, information or communication to MaMTus Centre, You agree and understand that You are communicating with MaMTus Centre through electronic records and You consent to receive communications via electronic records from MaMTus Centre periodically and as and when required MaMTus Centre may communicate with You by email or by such other mode of communication, electronic or otherwise.

Charges

Membership is free. MaMTus does not charge any fee for browsing and buying on www.mamtus.com . However MaMTus reserves the right at its sole discretion to introduce new services and modify some or all of the existing services offered.

You agree, undertake and confirm that your use of MaMTus Centre shall be strictly governed by the following binding principles:

On this website, all materials and products in addition to services ordered through us, included on or otherwise made available to you through this site are provided on MaMTus on “as is” and “as available” basis without any representation or warranties, express or implied except otherwise specified in writing. Without prejudice to the forgoing paragraph, www.mamtus.com does not warrant that:
liable to unauthorised use in any way or in relation to the contents of, or use of, or otherwise in connection with, www.mamtus.com website.

All the products sold on MaMTus are governed by Nigerian law and if MaMTus is unable to deliver such products due to implications of different known laws, www.mamtus.com will return or will give credit for the amount received by us from the sale of such product, that could not be delivered to you.

You will be required to enter a valid phone number and email while placing an order on www.mamtus.com . By registering your phone number with us, you consent to be contacted by MaMTus via phone calls, emails and / or SMS notifications, in case of any order or shipment or delivery related updates. MaMTus Centre will not use your personal information to initiate any promotional phone calls or SMS'.

Services

Payment to Service Providers
Paying service providers has been made easy through Mamtus internally developed platform. To ensure quality of service, all agreed fees must be paid through Mamtus to qualify for arbitration or refund in situation of dislike. It is the responsibility of the service providers to issue an electronic receipt upon agreement with clients or customers. Receipt issued only becomes valid after a client or customer accept terms and condition as set out in the receipt form. Mamtus cannot be hold responsible or ask to intervene for service charge not paid through the Mamtus platform.

Other Payment

While availing any of the payment method/s offered at www.mamtus.com ,MaMTus will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you due to:

1. Lack of authorization for any transaction/s, or

2. Exceeding the preset limit mutually agreed by you and between your "Bank/s", or

3. Any payment issues arising out of the transaction, or

4. Decline of transaction for any other reason/s.

All payments made against the purchases/services on www.mamtus.com by you shall be compulsorily in Nigerian Naira or its exchnage value for International cards acceptable by the Central Banks of Nigeria

Applicable Law

This Agreement shall be governed by and interpreted and construed in accordance with the laws of The Federal Republic of Nigeria. The place of jurisdiction shall be exclusively in Lagos, Nigeria.

Jurisdictional Issues/Sale in Nigeria Only

Unless otherwise specified or agreed, the material on MaMTus Centre is presented solely for the purpose of sale in Nigeria. Those who choose to access this site from other locations/Countries other than NIgeria do so on their own initiative and MaMTus Centre is not responsible for supply of goods/refund for the goods ordered from other locations/Countries other than Nigeria, compliance with local laws, if and to the extent local laws are applicable.

Trademark, Copyright and Restriction

This site is operated by GlobalPro Services Limited, Nigeria and supported ConnectSSA, Finland. All material on this site, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights that are owned and controlled by us or by other parties that have licensed their material to us. Material on www.mamtus.com web site owned, operated, licensed or controlled by us is solely for your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by e-mail or other electronic means and whether directly or indirectly and you must not assist any other person to do so. Risk of loss

All items purchased from MaMTus Centre are made pursuant to a FREE shipment contract. This means that the Risk of Loss shall remain with MaMTus until the item is transferred to You. In the event that the items are damaged after receipt, the risk falls on the customer.

Product Description

MaMTus Centre tries to be as accurate as possible. However, MaMTus does not warrant that product description or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by MaMTus Centre itself is not as described, your sole remedy is to return it in unused condition.

Pricing/Typo error

The price shown for the goods exclude VAT which will be shown at check out except otherwise. If a delivery surcharge is to be made it will be shown at the checkout or we will contact you before dispatch.If MaMTus comes across any difference in pricing resulting from typographic errors with regards to pricing or product information, MaMTus shall have the right to rectify the same or cancel the order(s) and refund monies.

Placing and Cancellation of order

MaMTus reserves the right to cancel any order without any explanation for doing so, under situation where MaMTus is not able to meet the requirement of the order placed or order so placed/cancelled does not comply with the MaMTus policy or for any reason. However,MaMTus Centre will ensure that any communication of cancellation of an order is intimated within appropriate time to the concerned person and any applicable refund, will be made in reasonable time.

Dispatch and Delivery Policy

Goods are normally dispatched same day for all orders made before 12 noon local Nigerian time and next day for orders made after 12 noon the previous day. However customers needs to confirm order placed to qualify for this same of next day shipment with full payment or part paymen as may ne agreed wth site administrator, usually through phone call or email customer service personnel. If we are unable to fulfil your order we will contact you and arrange either for an alternative to be sent or a full refund to be made.
Delivery is 3-7 days working days excluding weekends.

Force Majeure

Notwithstanding any other provision set forth in these terms and conditions, MAMTus shall not be liable for any failure or delay in its performance due to any cause beyond MAMtus reasonable control, including, without limitation, any act of war or civil insurrection, national emergencies, acts of God, fire, explosion, vandalism, storm, earthquake, flood, embargo, riot, sabotage, industry-wide strikes, lockouts, work stoppages or other labor difficulties, industry-wide supplier failures, unavailability of materials, rights of way or governmental acts; provided, however, that MAMTus shall use its commercially reasonable efforts to correct promptly such failure or delay in performance to the extent consistent with then applicable law
and regulatory requirements and appropriate in light of then existing circumstances.

Prohibited Use

User agrees that it will not use this web site to engage in any activity that could be deemed illegal, harmful to others, or give rise to civil liability. None of the above Terms and Conditions affects your statutory consumer rights.
